1. Introduction
Please read this Agreement carefully. It forms a legally binding agreement between you ("you" or "your") and Let Tech Solution Limited ("we", "us", or "our") which governs your use of our services (the "Service"). We reserve the right to amend this Agreement from time to time. You will be deemed to have read and accepted this Agreement, including any changes, each time you sign in to this website (the "Site").

2. Services

2.1 - Upon indicating your acceptance of this Agreement, you will be able to start creating your MyRentalCV. You will be prompted to enter or upload personal information and documents, and you must fulfil all such requests in full in order to successfully create your MyRentalCV. You may also be given the option of instigating a request as appropriate (i) to your employer to certify your employment and/or personal details, (ii) to educational institutions to confirm your matriculation with that institution, (iii) to a MyRentalCV certifying partner to review and confirm your identification documents, (iv) to a potential guarantor to confirm their willingness and capacity to act as such, and (v) to current or previous landlord(s) or letting agents to confirm or rate your previous tenancy/ies.

2.2 - You will be able to track responses from people or institutions we have contacted pursuant to 2.1 above, so that you can take action where no response has been received.

2.3 - Following receipt of your personal information, we will instigate a credit check on you and your guarantor, if applicable, via a credit reference agency and this will appear on your MyRentalCV. This process will be repeated each time you update your MyRentalCV. You or your guarantor will need to be resident in the United Kingdom for the purposes of the credit check. By ticking the relevant box before creating your MyRentalCV, you and your guarantor will have given explicit consent to us, each time we carry out a credit check (i) to use your/their personal information for this purpose and (ii) that the search footprint generated will read as having been made by you/them. We may search the files of credit reference agencies which may keep a record of that search. The agencies will record details of the search, whether or not any particular tenancy application is successful. Subsequently, letting agencies and landlords may use the results of the credit check (ie. the credit score) as part of their assessment of you or your guarantor. We may check your or your guarantor’s details with fraud detection agencies and if false or inaccurate information is provided and fraud is identified, details will be passed to fraud prevention agencies. Law enforcement agencies may also access and use this information.

2.4 -You will have access to your credit score for the purpose of verifying your credit status to prospective landlords and letting agents so that they can use it as part of their assessment of your suitability as a tenant. You agree not to alter, deface or misrepresent the credit score with the intention of misleading any third party under any circumstances.

2.5 - Where you are handling the personal data of other people in relation to this Agreement (such as the personal data of your guarantor), you agree to make sure that they are aware of your use of their personal data and that you have provided them with a copy of our Privacy Policy, which tells them about how we use personal data in compliance with the provisions of the Data Protection legislation and all other applicable legislation and regulations in relation to the credit check.

2.6 - You agree and understand in relation to the credit score that: (i) it is provided for guidance and information only; (ii) it is based on limited, publicly available information and is not a substitute for a credit report containing non-public data; (iii) it should not be relied upon for any particular purpose; and (iv) neither we nor the credit reference agency will be responsible or liable to you or any third party if the you choose to rely on the credit check or any part of it, or take any action in reliance on it.

2.7 - You further agree in relation to the credit check not to: (i) do anything which will render it inaccurate; or (ii) in any way de-value it.

2.8 - In the event of any queries or disputes regarding the information contained in the credit check, you should contact the credit reference agency directly via its Consumer Services Team on 0330 024 7574, or by visiting their website

2.9 - In the event that you choose to take a tenancy from one of our certification partners and you share your MyRentalCV with that certification partner and follow the required procedures, they will be able to do the following in relation to your MyRentalCV if requested:

2.9.1 - check the original versions of your identification documents, certify that they accurately reflect the digital copies you have uploaded, and confirm the likeness of any photos uploaded;

2.9.2 - confirm your new residential address, lease length and rental amount; and

2.9.3 - provide you with a rating at or towards the end of the tenancy. In the event that the certification partner provides a rating as a goodwill gesture before the tenancy has ended, they will have the right to amend that rating based on your acts or omissions at or following the end of that tenancy.

3. Your rights and obligations

3.1 - When the above steps are completed, your MyRentalCV will be generated and you will be able to view it at any time by signing in to the Site. You will also be able to print your MyRentalCV and to share it with interested parties including prospective landlords and letting agents when you are looking for a new property or applying for tenancies.

3.2 - Your most recent credit score will appear on your MyRentalCV. You should bear in mind that where you are using your MyRentalCV to help apply for a tenancy, your landlord or letting agent may require a current credit check in accordance with their policies.

3.3 - All information that you provide to us to enable us to provide the Services must be true, accurate, current and complete.

3.4 - It is your responsibility to provide us with all such information as we may reasonably request from time to time in order to enable us to fulfil our obligations under this Agreement. If you do not supply or we are unable to obtain required information, we may not be able to generate your MyRentalCV, or it may be adversely affected (for example, your tenant rating may be lower than it would otherwise have been), and if this happens we will accept no liability for any such consequences.

3.5 - When you register, you will be asked to create a password. You will be required to provide your full name and a valid email address. You must keep your registration details, and especially your password, secure and not disclose them to any other person. You are responsible for all activity carried out using your registration details, whether or not you have allowed or facilitated it. If you discover or suspect that your registration details are known by a third party or are being used without authorisation, you must tell us immediately by sending an email to support@myrentalcv.com.

3.6 - You are also responsible for keeping back-up copies of all information and documents you upload to the Site. You should not under any circumstances use or rely on the Site as a storage facility for any such information or documents.

3.7 - In the event that you believe that a reference or rating provided by a third party for your MyRentalCV is inaccurate or unfair, you should contact the provider in the first instance. If you do not receive a response within a reasonable time or are unhappy with the response, you can contact us at support@myrentalcv.com. We may make enquiries as a result of your contacting us, but we reserve the right in our sole discretion to decide whether to remove, edit or amend a reference or rating.

3.8 - You agree that in the event that a dispute arises between you and a third party providing information for or accessing your MyRentalCV, we will not become involved or mediate and will have no liability of any kind in connection with such dispute.

3.9 - We shall be entitled to immediately suspend provision of the whole or any part of the Services, or payments of credits under clause 4, in the event that you commit any breach of this Agreement. For the avoidance of doubt, any exercise of our rights under this clause shall not affect your obligations to pay us any sums due under this Agreement.

4. Termination

4.1 - This Agreement will continue in force until terminated in accordance with this clause 4.

4.2 - You may terminate this Agreement at any time by deactivating or deleting your account. Any subsequent reactivation or reinstatement of your account shall be subject the terms of this Agreement. If you wish to permanently delete your account, please notify us by emailing support@myrentalcv.com.

4.3 - We may terminate this Agreement:

4.3.1 - without notice, in the event that (a) you commit any material breach of this Agreement and (in the case of a breach which is not persistent and can be remedied) you fail to remedy such breach within 7 days of receipt of a written request to do so, (b) we discover that you have provided or uploaded false information or documents; or (c) if we consider in our sole discretion that you are misusing the Services or Site in any way, or are doing or have done anything which might affect our reputation or bring us into disrepute or damage our business in any way;

4.3.2 - upon 14 days’ notice, in the event that (a) we are unable to continue to provide the Services as a result of changes to legislation or any regulatory requirements by which we are bound, or (b) we cease trading for any reason.

4.4 - We may suspend your account in the event that we reasonably suspect that you may have committed a breach of this Agreement or the Website Terms of Use for the Site, or may be misusing the Services or Site in any way, or may be doing or have done anything which might affect our reputation or bring us into disrepute or damage our business in any way. If we suspend your account, we will notify you via email and you will have an opportunity to respond. Following enquiries, we may reinstate your account, or terminate it in accordance with 4(3) above, at our discretion.

4.5 - If we terminate this Agreement, you will no longer have access to your user account or MyRentalCV, or to any information or content on the registered users’ area of the Site. We may delete your information and uploaded documents and we will not be responsible for any consequences of such deletion to you or to any third party.

5. Data Protection & Confidentiality

5.1 - In providing the Services to you, we will need to use the personal information you provide about yourself. We will use your personal information in accordance with our Privacy Policy. You hereby agree that you have read and acknowledge the terms of our Privacy Policy.

5.2 - Both you and we agree to use reasonable endeavours to keep confidential any information disclosed to us by the other party which is obviously or likely to be confidential. Except to the extent expressly permitted by this Agreement, neither party will disclose any confidential information to any third party, except where necessary to: (i) fulfil its obligations under this Agreement and only after ensuring that that person will comply with the obligation of confidentiality, or (ii) comply with applicable laws or a court order.

6. Liability

6.1 - We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services.

6.2 - We are not liable for business losses. We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

6.3 - If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, [but we are not responsible for any loss or damage that is not foreseeable]. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

7. Website Terms and Conditions

7.1 - You hereby acknowledge that you have read our Website Terms of Use in respect of the Site and that you agree to their terms.

8. Intellectual Property

8.1 - The Company’s logo and any image on the Site or in material supplied by the Company which bears its name are trademarks of the Company. Except as expressly permitted in this Agreement, you are prohibited from using or displaying, and you agree not to use, display, or reference, any URL, trade name, trademark, logo, or branding of the Company in any manner whatsoever (including, without limitation, in any meta-tags, search engine advertising, marketing or optimization, any other online or offline marketing or advertising, press releases, etc.) without the express, written permission of the Company. All rights not expressly granted are reserved by the Company.

8.2 - Except as expressly permitted in this Agreement, you may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any intellectual property of the Company’s in any way or on any medium (including other websites) without our prior written consent. No express or implied right is granted to you under any of the Company’s trademarks, copyrights or other proprietary rights.

8.3 - All information and content uploaded or otherwise sent, by any means, by you to the Site or the Company, whether for a MyRentalCV or for any other purpose or reason, must not infringe any third party’s intellectual property or any other legal rights. You agree and warrant that you own or have permission from the owners to use any information or content you upload or send in the manner and for the purposes that you upload or send it.

8.4 - When you upload or send information or other content to or via the Site, you grant the Company a worldwide, royalty-free, sub-licensable, non-exclusive licence to reproduce, edit, transmit and publish the information or content for the purposes of this Agreement.

9. Third Party Services

9.1 – Some of the services offered from our Site are not provided by us, but are instead provided by various third party providers. For example, services which are designed to help you move property, and services which provide you with exclusive retail discounts and offers. In these circumstances, we provide the facilities necessary for you to engage with the third party providers (as this occurs via out Site), however we are not in any way responsible for the services that are provided to you by these third parties.

9.2 – Where you decide to purchase or obtain services from a third party via our Site, you will be required to enter into separate legal terms with that third party. The applicable third party will be responsible for the delivery of such services to you, and for any complaints or enquiries about those services that you may have.

9.3 – We facilitate third party services via our Site because we think these services will be of interest to you. However, any information on our Site about third party services should not be interpreted as approval by us of those third parties or the services that they provide. We have no control over any of the third parties who may provide services via our Site, and therefore we cannot accept any liability for any losses or damages that you may suffer as a result of engaging with any such third parties.

10. General

10.1 - Entire Agreement: This Agreement constitutes the entire agreement between us and you relating to the provision of the Services and shall supersede all prior agreements and understandings between us and you with respect to the provision of the Services.

10.2 - Severability: If any provision or part of this Agreement is deemed to be illegal, unenforceable or invalid for any reason, it shall be deemed to have been struck out and the remaining parts or provisions shall survive and continue to be binding and enforceable.

10.3 - No waiver: Any failure by us to enforce any provision of these terms and conditions at any time shall not be construed as a waiver of such provision and shall not affect our right to enforce such provision, nor will any waiver of rights operate as a waiver of subsequent rights.

10.4 - Assignment and Sub-contracting: You shall not be entitled to assign, transfer, subcontract or otherwise make over any right or obligation under this Agreement to any other person without our prior written consent. We may assign or sub-contract the whole or any part of our rights and/or obligations under this Agreement to any other person, entity, firm or company.

10.5 - Unforeseen Circumstances: Neither party shall be liable for any delay in performing any of its obligations hereunder if such a delay is caused by circumstances beyond the reasonable control of the party so delaying and such party shall be entitled to a reasonable extension of time for the performance of such obligations. Such delay shall not constitute a breach of this Agreement, provided however that if such delay continues for a period in excess of 30 days, the party not in delay shall be entitled to terminate this Agreement forthwith by written notice to the other party.

10.6 - Rights of Third Parties: In accordance with the Contract (Third Party Rights) (Scotland) Act 2017 Transunion Ltd (our chosen credit reference agency) will have the right to enforce clauses 2.3, 2.4, 2.5 and 9.4 of this Agreement.

10.7 - Jurisdiction: These terms and conditions are to be governed by and construed in accordance with Scottish law and any dispute or question in connection with them will be subject to the non-exclusive jurisdiction of the courts of Scotland.
